CPRA PRIVACY NOTICE TO CALIFORNIA JOB APPLICANTS REGARDING THE COLLECTION OF PERSONAL INFORMATION

Mellow, Inc. and its operating groups, subsidiaries and affiliates,(the “Company” or “we”) are committed to protecting the privacy and security of personal information of all individuals including job applicants.  The Company complies with the California Privacy Rights Act (CPRA) and all data privacy and laws in the jurisdictions in which it recruits and hires employees. 

 

We do not:

Sell your personal information;

Share or disclose your personal information to third parties other than the entities or service providers listed below;

Share or disclose your sensitive information to third parties for purposes other than those listed below; or permit third parties to collect your personal information on our behalf other than our service providers listed below.

Categories of Personal Information We Collect and How Do We Use, Retain, and Share This Information

We collect information from job applicants that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular job applicant ("personal information"). We have collected the following categories of personal information from its job applicants within the last twelve (12) months:

We use this type of information for:

- Workforce recruiting activities

- Reviewing job applicant submissions

- Comparing job requirements against qualifications

- Conducting any necessary background checks after the offer stage

- Communicating with you about job application status

As long as necessary to fulfill the purposes for the collection. Generally, personal information is retained for the duration of our hiring process or continuing relationship with you, plus any legally required record or data retention period and/or any period of time necessary to exercise our legal rights.

Once we no longer have a legal or business purpose for the information and no legal requirement to maintain the information, we will promptly purge the information

Company personnel involved with hiring, recruitment service providers, background check service providers, former employers, references you provide, applicable law enforcement and government agencies.

Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)).

Such as a name, signature, Social Security number, physical characteristics or description, address, telephone number, passport number, driver's license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information.

- Necessary to comply with a legal obligation

As  long as we have a legal or business purpose for it or a legal requirement to maintain it. Once we no longer have a legal or business purpose for the information and no legal requirement to maintain the information, we will promptly purge the information.

Company personnel involved with hiring, recruitment service providers, background check service providers, Human Resources information service providers, former employers, references you provide, applicable law enforcement and government agencies.

Protected categories such as race, color, national origin, sex, disability, age, citizenship status, military or veteran status.

Professional or employment-related information such as job preference and work availability; qualifications; employment history and experience; compensation; military service; reference and background check information, including relevant criminal history and credit history; pre-employment test results; immigration and work eligibility; and information provided by you during the interview and hiring process

Education information relevant to the job

Hire the best-qualified applicants, comply with our legal and contractual requirements, and to establish, exercise our legal and contractual rights

Generally, personal information is retained for the duration of our hiring process or continuing relationship with you, plus any legally required record or data retention period and/or any period of time necessary to exercise our legal rights

Human Resources information service providers, our recruitment service providers, our  background check service providers, applicable law enforcement and governmental agencies, your former employers, and references you provide

Non-public education information (per the Family Educational Rights and Privacy Act (20 U.S.C. Section 1232g, 34 C.F.R. Part 99)).

 

Education records directly related to a student maintained by an educational institution or party acting on its behalf, such as grades, transcripts, class lists, student schedules, student identification codes, student financial information, or student disciplinary records.

Inferences drawn from the personal information collected to determine your abilities and aptitude

Examples listed herein are illustrative of the types of personal information included in each category and may or may not be the specific types of personal information collected on an individual employee or job applicant. Some personal information included in these categories may overlap with other categories.

Note: Subject to applicable local law, and for certain limited roles, Mellow, Inc. may also receive information such as your education and work experience, contact information, demographics, and credit report information, from third-party data providers who have the rights to provide us with your information.

SSI obtains the categories of personal information listed above from the following categories of sources:

  • Directly from you. For example, from forms you complete.
  • Third Parties. For example, from vendors used for background checks.

 

In addition to the purposes identified above, Company may use and disclose any and all personal information that we collect as necessary or appropriate to:

  • Comply with laws and regulations, including (without limitation) applicable tax, health and safety, anti-discrimination, immigration, labor and employment, and social welfare laws.
  • Monitor, investigate, and enforce compliance with and potential breaches of Company policies and procedures and legal and regulatory requirements.
  • Comply with civil, criminal, judicial, or regulatory inquiries, investigations, subpoenas, or summons.
  • Exercise or defend the legal rights of Company and its employees, affiliates, customers, contractors, and agents
  • To fulfill or meet the reason you provided the information. For example, to determine the viability of your candidacy.
  • To provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses.

Your Privacy Rights

As a California resident, you have the following privacy rights regarding your personal information:

The right to know and right to access the personal information we have collected about you, including the categories of personal information, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling, or sharing personal information, the categories of third parties to whom the business discloses personal information, and the specific pieces of personal information the business has collected about the consumer.

The right to delete personal information that we have collected from you, subject to certain exceptions.

The right to correct inaccurate personal information that we maintain about you.

The right of portability, or right to have us transfer your personal information to other persons or entities upon your request.

The right to limit the use of your sensitive information if we decide in the future to use such information for purposes other than the purposes listed above.

 

Exercising your Rights

To exercise your rights described above, please submit a request by either:

To protect the security of your personal information, we will require you to provide us with identifying information for you such as personal email address, personal telephone number, employee identification number, and/or other information that we can match with the personal information we have collected about you to verify your identity. 

 

You may use an authorized agent to request access to or deletion of your personal information. We will require your authorized agent to provide us with either (1) a power of attorney authorizing the authorized agent to act on your behalf or (2) your written authorization permitting the authorized agent to request access to your personal information on your behalf.  Further, we will require you or your authorized agent to provide us with identifying information to verify your identity.  We may also require you to either verify your own identity directly with us or directly confirm with us that you provided the authorized agent permission to submit the request.

 

Within 10 days of receiving your request to know, we will confirm receipt of your request and provide information about how we will process your request.  Generally, we will respond to your request within 45 days.  If we need more time to respond, we will provide you with notice and an explanation of the reason we need more time to respond.  We may deny your request if we cannot verify your identity or are legally permitted to deny your request.  If we deny your request, we will explain the basis for the denial, provide or delete any personal information that is not subject to the denial, and refrain from using the personal information retained for any purpose other than permitted by the denial. We will maintain a record of your request and our response for 24 months.

 

Changes to This Privacy Notice

Mellow, Inc. reserves the right to amend this privacy notice at our discretion and at any time. When we make changes to this privacy notice, we will update this privacy policy on and post the updated notice on our website at www.mellow-home.com and update the notice's effective date.
